These Terms and Conditions govern your use of this website and your purchase of consultations, downloadable visa application checklists and related products or services from Happy Migration Pty Ltd. By using the website or completing a purchase, you agree to these terms.

Services and purchases

Service descriptions, prices and availability are displayed on the website and may be updated from time to time. Prices are in Australian dollars and GST inclusive unless stated otherwise. Payment must be completed before a consultation or digital product is supplied.

You must provide complete and accurate information when making a booking or purchase. You are responsible for checking the booking date, time, time zone, service description and contact details before confirming payment.

Consultations

A consultation is limited to the duration and scope stated at the time of booking. Additional advice, document preparation, application assistance, representation or follow-up work is not included unless expressly stated.

Booking a consultation does not by itself create an ongoing client-agent relationship. Any further immigration assistance or representation will be subject to acceptance of instructions and, where required, a separate written service agreement.

You must not record a consultation without the prior consent of everyone participating.

Downloadable checklists

Visa application checklists provide general guidance based on information available on the date shown on the product. Visa laws, policies, procedures, fees and document requirements can change without notice. You must confirm the current requirements applicable to your circumstances before relying on a checklist or lodging an application.

Purchasing a checklist grants you a limited, personal, non-exclusive and non-transferable licence to use it for your own purposes. You must not reproduce, modify, publish, share, distribute, resell or commercially exploit it without our written permission.

Intellectual property

Unless otherwise stated, the website and its original content, branding, checklists, templates and resources are owned by or licensed to Happy Migration Pty Ltd. Government forms and third-party materials remain the property of their respective owners.

Acceptable use

You must not misuse the website, interfere with its operation, attempt unauthorised access, submit unlawful or harmful content, infringe another person’s rights or use purchased materials contrary to these terms.

Third-party services and links

The website may use or link to third-party booking, payment, communication and information services. Those services may have separate terms and privacy policies. We are not responsible for third-party content or systems outside our reasonable control.

Limitation of liability

To the maximum extent permitted by law, we are not liable for loss arising from inaccurate or incomplete information supplied by you, changes in legislation or government policy, decisions or delays by government authorities, third-party system failures, or use of a checklist without obtaining advice appropriate to your circumstances.

Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Governing law

These terms are governed by the laws of Queensland, Australia. The parties submit to the jurisdiction of the courts and tribunals of Queensland and any courts entitled to hear appeals from them.
